Terms of Service

These terms govern your use of the PharmaMonitor website, our pilot programme, and the PharmaMonitor Sales Force Automation platform (the “Service”). By using the Service you agree to them. Where a signed agreement exists between us and your organisation, that agreement takes precedence over these terms.

1. Who May Use the Service

The Service is offered to businesses. Accounts are provisioned to an organisation (the “Customer”), which is responsible for creating, managing and deactivating its users' accounts, and for the accuracy of the data it uploads. Individuals may only use the Service through an account issued to them by their employer.

2. Pilot Programme

  • The pilot runs free of charge for 30 days from the agreed start date. No payment instrument is required and the pilot does not convert to a paid plan automatically.
  • Pilot participation involves commitments described at the point of application, including putting an agreed number of field representatives on the app and taking part in periodic feedback calls. These are good-faith expectations, not enforceable obligations.
  • Either party may end the pilot at any time, for any reason, with written notice. On request we will provide an export of the Customer's data before the account is closed.
  • Features described as planned or in development during a pilot are not commitments and may change.

3. Subscriptions and Billing

  • Paid plans are billed per active field representative per month. An active representative is a user holding the MR role who signs in at least once during the billing cycle.
  • A minimum of 10 representatives, or a floor of ₹20,000 per month for smaller teams, applies to paid plans. Adding representatives mid-cycle is prorated.
  • Prices shown on this website are exclusive of applicable taxes and may change on renewal with prior notice. Prices agreed in a signed order form apply for that term.

4. Customer Data

The Customer retains ownership of all data it uploads to or generates within the Service. We process that data only to provide and support the Service, in line with our Privacy Policy. Each Customer's data is held in a separate database schema.

The Customer is responsible for having a lawful basis to collect and process the personal data of its own employees and contacts through the Service, including location data captured from field representatives, and for informing them accordingly.

5. Acceptable Use

You agree not to:

  • use the Service to store patient health records or other sensitive health information;
  • attempt to access another tenant's data, or probe or disrupt the Service;
  • resell, sublicense or white-label the Service except where expressly agreed in writing;
  • use the Service in breach of applicable law or of pharmaceutical marketing codes.

6. Availability and Support

We aim to keep the Service available continuously and to respond to support requests within the times stated on your plan. Contractual uptime commitments are available only where they are set out in a signed Enterprise agreement; no service level is promised on the pilot or on self-serve plans.

7. Suspension and Termination

Either party may terminate a subscription at the end of its current term with written notice. We may suspend access where an account is materially overdue, or where use of the Service threatens its security or integrity, and we will give notice where it is practical to do so. On termination, we will make the Customer's data available for export for 30 days, after which it may be deleted.

8. Disclaimers and Liability

The Service is provided on an “as is” basis. Verification features such as geofenced check-ins are designed to make unverified reporting substantially harder; they are not a guarantee that all reporting is accurate, and decisions taken on the basis of data in the Service remain the Customer's own. To the extent permitted by law, neither party is liable for indirect or consequential loss, and our aggregate liability is limited to the fees paid for the Service in the twelve months preceding the claim.

9. Changes to These Terms

We may update these terms. Where a change is material we will give notice to account administrators before it takes effect. Continued use after that date constitutes acceptance.

10. Governing Law

These terms are governed by the laws of India, and the courts at Delhi have exclusive jurisdiction over any dispute arising from them.
